Terms and Conditions

These Terms and Conditions ("Terms") are a legally binding agreement between you and Unplastic Labs LLC, a North Carolina limited liability company ("Unplastic Labs," "we," "us," or "our"). By purchasing a membership, affirmatively accepting these Terms during checkout or onboarding, creating or using a member account, or accessing member-only content, you agree to these Terms and our Privacy Policy.
If you do not agree, do not purchase a membership, complete onboarding, create or use a member account, or access member-only content.
1. About Unplastic Labs and Defined Terms
Unplastic Labs LLC is an independent, member-funded research organization that designs, funds, and coordinates consumer product research and testing. Depending on the Research Season and study, that work may include testing for microplastics, PFAS, pesticides, heavy metals, and other contaminants. Our research is provided for informational and educational purposes only. We are not a medical provider, clinical laboratory, diagnostic service, or healthcare provider.
For these Terms:
"Platform" means our public website, member portal, onboarding pages, databases, publications, communications, and related services.
"Research Season" means a defined period in which member contributions support the planning, selection, testing, analysis, and publication of consumer product research.
"The Signal" means the members-only publication through which findings from a Research Season are made available.
"Member" means any person who purchases a seasonal membership or uses a member account.
2. Eligibility and Accounts
You must be at least eighteen (18) years old, or the age of legal majority where you live, and capable of entering into a binding contract. You agree to provide accurate information during checkout, onboarding, and account use.
You are responsible for protecting access to your email account, member account, and login links. You may not share, sell, or transfer your account or membership without our written permission. Please notify us promptly if you believe your account has been accessed without authorization.
3. Membership Tiers
Each membership is purchased for one Research Season. Membership is not a subscription and does not automatically renew.
3.1 Member
The Member tier includes access to The Signal and the results database made available for the applicable Research Season, the ability to propose products or contaminants for future consideration, and participation in supporting additional independent testing.
3.2 Investigator
The Investigator tier includes all Member benefits plus voting rights on studies, products, or categories presented to Investigators for the applicable Research Season.
3.3 Patron
The Patron tier includes the same contractual membership benefits as the Investigator tier, together with a voluntary additional contribution in an amount selected by the Patron at checkout to support the Unplastic Labs research mission. The amount paid is the amount displayed and accepted at checkout.
Any amount paid above the Investigator tier price displayed at checkout does not create additional voting power, guaranteed access, guaranteed recognition, or other contractual rights unless expressly stated at checkout. Patron contributions are not charitable donations and are not represented as tax-deductible.
From time to time, we may offer Patrons discretionary gestures of appreciation, such as recognition, early previews, invitations, or other opportunities. These gestures are not guaranteed and do not form part of the consideration for the Patron contribution.
3.4 Community Input and Final Research Decisions
Member proposals and Investigator votes are important inputs into our research planning. We will consider Investigator voting results in good faith and will seek to reflect community priorities where scientifically, financially, legally, and operationally feasible.
Voting and proposals do not guarantee that a particular study, product, brand, contaminant, method, or sample will be selected or completed. Unplastic Labs retains final authority over study selection, methodology, sample selection, laboratory choice, timing, budget, interpretation, and publication.
4. Pricing, Payment, and No Automatic Renewal
4.1 One-Time Seasonal Purchase
The price for each membership tier is the amount displayed and accepted at checkout. For the Patron tier, the total price includes the voluntary additional contribution selected at checkout.
One payment covers the applicable Research Season. There is no automatic renewal. You will not be charged for another season unless a later season opens and you affirmatively choose to join it.
Prices for future Research Seasons may change. A future price change will not increase the price of a purchase you have already completed.
4.2 Payment Processing
Payments are processed by third-party payment providers. By submitting payment information, you authorize the applicable provider and Unplastic Labs to process the one-time charge shown at checkout. We do not guarantee that every payment method will remain available.
5. Refund Policy
5.1 Why We Offer a Pre-Publication Refund
Independent research can take time, including while a Research Season builds sufficient member support and studies are designed, funded, and scheduled. We do not want members to remain financially committed before the season's findings are released. For that reason, members may withdraw and request a refund under the conditions below.
5.2 Full Refund Before The Signal Is Released
You may withdraw from the applicable Research Season and request a full refund of the amount you paid at any time before Unplastic Labs publishes or makes available to members The Signal for that Research Season.
For a Patron purchase, the full refund includes the standard membership price and the voluntary additional Patron contribution paid for that Research Season.
5.3 How to Request a Refund
To request a refund, email support@unplasticlabs.com from the email address associated with your purchase. Include your full name and a clear statement that you are requesting a refund for the applicable Research Season. A portal refund button or cancellation workflow is not required.
Approved refunds will be returned to the original payment method whenever reasonably possible. We will initiate the refund promptly after confirming the purchase and eligibility. The time for funds to appear depends on the payment processor and your financial institution.
Once a refund is issued, your membership in that Research Season ends. We may remove associated portal access, voting rights, and access to member-only season materials.
5.4 After The Signal Is Released
Once Unplastic Labs publishes or makes available to members The Signal for the applicable Research Season, the purchase becomes final and non-refundable, except where required by law or where Unplastic Labs expressly agrees otherwise. This applies even if you have not opened, read, downloaded, or reviewed The Signal.
5.5 Season Cancellation
If Unplastic Labs cancels a Research Season before publishing or making available The Signal for that Research Season, we will provide members of that season a full refund. We may process the refund automatically without requiring a request.
5.6 Fraud, Refund Abuse, Chargebacks, and Material Breach
The pre-publication refund right does not require us to provide a refund to an account terminated for fraud, unauthorized payment activity, chargeback abuse, unlawful conduct, or a material breach of these Terms, except where required by law. Unplastic Labs may also deny a refund where documented account or payment history shows a repeated pattern, across multiple purchases or accounts, of obtaining member-only access and then requesting refunds. A single good-faith refund request will not, by itself, constitute such a pattern.
6. Research Timing, Scope, and Changes
6.1 Timing
Unless we expressly state otherwise in writing, a Research Season does not have a guaranteed completion or publication date. Research timing may depend on member participation, funding, study design, method development, product and sample availability, laboratory capacity, quality review, repeat testing, legal review, and other scientific or operational considerations.
We will make good-faith efforts to complete the Research Season carefully and efficiently and to provide meaningful updates when timing or scope changes materially. The pre-publication refund right in Section 5 remains available until The Signal for the Research Season is published or made available to members.
6.2 Funded, Proposed, and Confirmed Studies
Our website or portal may describe studies as proposed, under consideration, funded, confirmed, in development, in testing, or otherwise planned. These descriptions reflect the status and information available at that time.
We will make good-faith efforts to complete studies described as funded or confirmed. However, study details may be modified, delayed, substituted, narrowed, expanded, or discontinued when reasonably necessary because of scientific validity, laboratory or method limitations, product availability, legal or safety concerns, budget constraints, quality-control findings, or other operational circumstances.
6.3 Laboratories and Accreditation
Testing may be conducted through independent third-party laboratories selected for capabilities appropriate to the study. Where we describe a laboratory, method, or analysis as accredited, that description refers to the applicable accreditation and scope relevant to the work being performed. Not every procedure, analyte, interpretation, or activity is necessarily covered by the same accreditation scope.
6.4 No New Automatic Commitment
A delayed Research Season does not enroll you in a later season or authorize any additional charge. We generally do not intend to open a new paid Research Season before The Signal for the prior Research Season has been published or made available to members, but we may continue planning, collecting proposals, or communicating about future research.
7. Research and Health Disclaimer
All research conducted by or on behalf of Unplastic Labs is intended solely for informational and educational purposes. The Signal and other research materials are not medical advice, diagnosis, treatment, risk assessment for a particular person, or a substitute for advice from a qualified healthcare professional.
Research findings reflect the specific products, samples, lots, conditions, methods, detection limits, and time periods tested. Findings about a sample do not necessarily establish the condition of every unit, lot, formulation, brand, category, geographic market, or future version of a product.
We seek to describe what the evidence shows, what it does not prove, and the limitations of the work. You remain responsible for decisions you make based on the research and should consult qualified professionals regarding personal health, medical, legal, financial, or safety questions.
8. Communications
8.1 Account and Service Emails
We may send emails reasonably related to your purchase, account access, login links, receipts, onboarding, research-season administration, voting, service changes, security, The Signal, and other membership services. These communications are part of providing the membership you requested.
We may also send promotional emails as permitted by applicable law. You may unsubscribe from promotional emails using the unsubscribe method included in those messages. Unsubscribing from promotional emails will not necessarily stop account, transactional, security, or other service-related communications.
8.2 Current-Season Informational Text Messages
When you submit a mobile number during onboarding, we use that number to deliver The Signal when it publishes and to reach you if the lab finds something urgent that cannot wait. You may reply STOP at any time, or email support@unplasticlabs.com to opt out.
Submitting a mobile number for these current-season informational messages does not by itself enroll you in promotional text messages about future seasons.
8.3 Optional Promotional Text Messages
If you separately select "Yes, text me when the next season opens," you agree to receive recurring automated marketing texts from Unplastic Labs at the number you provided about new seasons and ways to stay involved. Message frequency varies. Consent to promotional texts is not required to purchase or maintain a membership. Message and data rates may apply. Reply STOP to opt out or HELP for help. You may also contact support@unplasticlabs.com.
Agreeing to these Terms alone does not enroll you in promotional text messages. Promotional text consent depends on your separate affirmative selection.
8.4 Revocation and Number Responsibility
You may withdraw text-message consent at any time by a reasonable method, including replying STOP to a message or emailing support@unplasticlabs.com. We may send a one-time confirmation that your opt-out was processed.
You represent that you are the subscriber or customary user of the mobile number you provide, or that you are authorized to consent to messages at that number. Please notify us promptly if your number changes, is reassigned, or is no longer under your control.
8.5 Carriers and Delivery
Wireless carriers and messaging providers are not responsible for delayed or undelivered messages. Delivery may depend on network availability, device settings, carrier policies, and third-party services.
9. Privacy
Our collection, use, storage, disclosure, and protection of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy may address, among other things, payment and account information, member profile information, self-reported health interests, mobile numbers, communication choices, consent records, device and browser information, and third-party service providers.
If these Terms and the Privacy Policy conflict regarding how personal information is handled, the Privacy Policy controls.
10. Intellectual Property and Permitted Use
The Signal, results database, reports, written analyses, graphics, methodologies, website content, branding, and related materials produced or provided by Unplastic Labs are owned by Unplastic Labs LLC or its licensors and are protected by applicable intellectual-property laws (collectively, "Unplastic Labs Materials").
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Unplastic Labs Materials for your own non-commercial purposes.
You may truthfully discuss, reference, summarize, or share your honest assessment of our research findings, including publicly and on social media. Nothing in these Terms is intended to restrict truthful statements, honest reviews, personal experiences, or lawful criticism.
You may not, without our written permission:
reproduce, republish, distribute, sell, post, or make available The Signal, database entries, reports, or other Unplastic Labs Materials in whole or in substantial part;
systematically scrape, extract, copy, download, or redistribute the database or a substantial collection of findings;
use the Unplastic Labs Materials or a substantial collection of derived findings for a commercial product, competing publication, dataset, model, service, or training corpus;
remove or obscure copyright, attribution, trademark, or proprietary notices; or
misrepresent our findings or attribute statements to Unplastic Labs that we did not make.
We may publish excerpts, summaries, or public versions of findings for informational, educational, or promotional purposes.
11. Member Conduct
You agree not to:
access or attempt to access another person's account or restricted portions of the Platform;
interfere with, disrupt, damage, reverse engineer, probe, or circumvent the Platform or its security;
upload malicious code or use automated systems in a manner that burdens the Platform;
use the Platform or Unplastic Labs Materials unlawfully or in violation of another person's rights;
harass, threaten, impersonate, or deceive members, contractors, laboratories, employees, or representatives; or
engage in conduct prohibited by Section 10.
12. Suspension and Termination
We may suspend or terminate access for fraud, unauthorized payment activity, security threats, unlawful conduct, material breach of these Terms, or conduct that materially harms the Platform, our research, our rights, or other users.
Where reasonably appropriate, we may provide notice and an opportunity to correct a breach. We are not required to provide advance notice where immediate action is reasonably necessary for security, legal compliance, fraud prevention, or protection of people or property.
Termination does not affect provisions that by their nature should survive, including payment obligations already incurred, intellectual-property restrictions, disclaimers, limitations of liability, dispute resolution, indemnification, and general provisions.
13. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM, MEMBERSHIP, THE SIGNAL, DATABASE, RESEARCH MATERIALS, COMMUNICATIONS, AND RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." UNPLASTIC LABS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY PARTICULAR STUDY, RESULT, TIMELINE, PRODUCT, METHOD, OR OUTCOME WILL BE AVAILABLE.
Some jurisdictions do not allow certain warranty disclaimers. In those jurisdictions, the disclaimers apply only to the extent permitted by law.
14. Limitation of Liability
14.1 Excluded Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNPLASTIC LABS AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR PERSONAL OR PROPERTY LOSSES ARISING FROM USE OF OR RELIANCE ON THE PLATFORM, THE SIGNAL, RESEARCH MATERIALS, OR RELATED SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
14.2 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL CUMULATIVE LIABILITY OF UNPLASTIC LABS AND THE OTHER COVERED PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO A RESEARCH SEASON, THESE TERMS, OR THE PLATFORM WILL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID TO UNPLASTIC LABS FOR THE RESEARCH SEASON GIVING RISE TO THE CLAIM.
14.3 Non-Excludable Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. The limitations in this Section apply to the maximum extent permitted by law and reflect the allocation of risk underlying the membership price.
15. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Unplastic Labs LLC and its members, managers, officers, employees, contractors, agents, successors, and assigns from third-party claims, losses, liabilities, damages, judgments, and reasonable costs arising from your unlawful conduct, your unauthorized commercial use or redistribution of Unplastic Labs Materials, your infringement of another person's rights, or your material breach of these Terms.
We may assume control of the defense of a matter subject to indemnification. You agree to provide reasonable cooperation. You may not settle a covered claim in a manner that admits liability by or imposes obligations on Unplastic Labs without our written consent.
16. Dispute Resolution
16.1 Informal Resolution
Before initiating arbitration or litigation, you and Unplastic Labs agree to make a good-faith effort to resolve the dispute informally. A member may begin this process by emailing legal@unplasticlabs.com with a description of the issue and the requested resolution. Either party may proceed after thirty (30) days if the dispute has not been resolved, unless a shorter period is reasonably necessary to preserve a claim or seek urgent relief.
16.2 Binding Individual Arbitration
Except for the matters described in Section 16.3 and unless you timely opt out under Section 16.7, any dispute, claim, or controversy arising out of or relating to these Terms, your membership, a Research Season, or the Platform will be resolved by final and binding individual arbitration rather than in court.
Arbitration will be administered by the American Arbitration Association ("AAA") under the then-current AAA Consumer Arbitration Rules and Mediation Procedures applicable when the claim is filed. If AAA is unavailable or declines to administer the matter, the parties will attempt to agree on another administrator. If they cannot agree, a court of competent jurisdiction may appoint one.
16.3 Small Claims and Injunctive Relief
Either party may bring an individual claim in a court of competent small-claims jurisdiction if the claim qualifies and remains an individual, non-representative claim.
Either party may seek temporary or emergency injunctive relief from a court where reasonably necessary to preserve the status quo, prevent imminent harm, protect confidential information, protect intellectual-property rights, or prevent unauthorized access to or distribution of member materials. Seeking such relief does not waive arbitration of the underlying dispute.
16.4 Arbitration Procedure and Location
The arbitration may be conducted by documents, telephone, video conference, or an in-person hearing, as permitted by the AAA rules and selected by the arbitrator after considering the parties' circumstances. An in-person hearing will take place in Mecklenburg County, North Carolina, unless the AAA rules, applicable law, or the arbitrator require or permit another reasonably accessible location.
The arbitrator may award any individual relief that a court could award, but only to the extent necessary to resolve the individual claim. The award will be in writing and will state the essential findings and conclusions. Judgment on the award may be entered in any court of competent jurisdiction.
16.5 Arbitration Fees and Attorneys' Fees
AAA filing, administrative, and arbitrator fees will be allocated under the then-current AAA Consumer Arbitration Rules and fee schedule. Unplastic Labs will pay the amounts it is required to pay under those rules. For an individual claim seeking less than $10,000, Unplastic Labs will also reimburse the consumer filing fee after the claim is filed, unless the arbitrator determines that the claim was frivolous or brought in bad faith.
Each party is responsible for its own attorneys' fees unless a statute, the AAA rules, or the arbitrator permits an award of fees.
16.6 Class and Representative Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISPUTES MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY. NEITHER YOU NOR UNPLASTIC LABS MAY PARTICIPATE AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE PROCEEDING.
If a final decision determines that this waiver is unenforceable as to a particular claim or request for relief, that claim or request will proceed in a court of competent jurisdiction after all arbitrable claims have been completed, unless applicable law requires otherwise.
16.7 Right to Opt Out of Arbitration
You may opt out of Sections 16.2 through 16.6 by emailing legal@unplasticlabs.com within thirty (30) days after the date you first agree to these Terms. Your notice must include your full name, the email associated with your membership, and a clear statement that you are opting out of the arbitration agreement.
Opting out will not affect your membership or the remaining provisions of these Terms. If you opt out, disputes will be resolved under Section 16.8.
16.8 Governing Law and Court Venue
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions.
For disputes that are not subject to arbitration, you and Unplastic Labs consent to the exclusive jurisdiction of the state and federal courts located in Mecklenburg County, North Carolina, except that an eligible individual claim may be brought in small claims court as provided above.
16.9 Survival
This Section survives termination of membership, account closure, refund, and termination of these Terms.
17. Changes to These Terms
We may update these Terms from time to time. The updated version will state a revised Effective Date or Last Updated date.
For non-material changes, posting the updated Terms on the Platform is sufficient notice. For material changes affecting current members, we will provide reasonable advance notice by email, through the Platform, or by another appropriate method. Material changes will not apply retroactively to a dispute that arose before the change.
Where applicable law requires affirmative agreement to a change, we will request it. If you do not agree to a prospective material change, you may stop using the Platform. Any refund rights will be determined under the version of the Terms applicable to your purchase unless we expressly provide a more favorable right.
18. Force Majeure
Unplastic Labs will not be liable for delay, interruption, or failure caused by events beyond our reasonable control, including natural disasters, fire, flood, public-health emergencies, government action, legal or regulatory changes, laboratory closure, loss of laboratory access, supply-chain disruption, product unavailability, cyberattack, utility or telecommunications failure, payment-provider interruption, or other events that make performance impracticable.
We will make good-faith efforts to resume affected operations and communicate material delays when reasonably practicable. Regardless of the cause of delay, the pre-publication refund right in Section 5 remains available until The Signal for the applicable Research Season is published or made available to members.
19. General Provisions
19.1 Entire Agreement
These Terms, the Privacy Policy, the disclosures and selections presented during onboarding, and any offer-specific terms displayed at checkout form the entire agreement between you and Unplastic Labs regarding the membership and Platform. If an offer-specific checkout term conflicts with these Terms, the more specific checkout term controls for that purchase, except that promotional SMS consent is governed by your separate affirmative selection.
19.2 Severability
If a provision is found invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable or, if that is not possible, severed. The remaining provisions will remain in effect.
19.3 No Waiver
A failure or delay in exercising a right does not waive that right. A waiver is effective only if in writing and signed by an authorized representative of Unplastic Labs.
19.4 Assignment
You may not assign or transfer your membership or rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, financing, operation of law, or transfer of the Platform, provided the assignee assumes the applicable obligations.
19.5 No Third-Party Beneficiaries
These Terms do not create rights for any third party, except for parties expressly protected by the disclaimers, limitations of liability, and indemnification provisions.
19.6 Electronic Notices
You consent to receive notices electronically at the email address associated with your account or through the Platform. You are responsible for keeping your email address current.
19.7 Headings
Headings are for convenience and do not affect interpretation.
